Assessment of Fair Housing (AFH)
Notice is hereby given that the City of Santa Fe will file their Assessment of Fair Housing (AFH) with the U.S. Department of Housing & Urban Development (HUD) on October 4, 2017. To review the draft, click here.
Each year, HUD provides block grants to states, urban counties and large cities for community development and housing activities. States and qualifying counties and cities choose how to invest those dollars to meet their needs, within certain parameters. For example, the investments must assist low to moderate income households or low income neighborhoods.
The primary community development and housing block grants are:
- Community Development Block Grant (CDBG)-established in 1974
- HOME Investment Partnerships Program (HOME)—established in 1990
- Emergency Solutions Grant (ESG)—established in 1987
- Housing Opportunities for Persons with HIV/AIDS (HOPWA)—established in 1992
As a condition of receiving these funds, states, counties and cities must certify that they will “Affirmatively Further Fair Housing” choice—or AFFH. The AFFH requirement originates from the Fair Housing Act of 1968, which requires that HUD administer programs and activities relating to housing and urban development in a manner that affirmatively furthers the policies of the Act. The City of Santa Fe will have the AFH available for public inspection prior to its submission. Members of the public are invited to review the AFH prior to its submission during the hours of 8:30 a.m. to 5:00 p.m., Monday through Friday, September 1 through 30, 2017, at the City of Santa Fe’s Office of Affordable Housing (500 Market Street); the Genoveva Chavez Community Center (3221 Rodeo Rd); and the Southside Library (6599 Jaguar Dr) and on the city’s website at santafenm.gov/affordable_housing. What is housing discrimination?
- Have you ever been charged higher rent or told you couldn't rent because you have kids under 18?
- Has your landlord not allowed you to make changes to your home (at your expense) that need to be made because you or a family member has a disability?
- Has an insurance company refused to provide full insurance replacement coverage for your home because of the neighborhood in which your home is located?
- Have you ever been offered non-standard and unfavorable terms in the purchase of a home?
If you suspect discrimination, you can file a complaint form with the US Department of Housing and Urban Development (HUD). HUD will investigate the discrimination and pursue legal action on your behalf.

Fair Housing Laws
Federal Fair Housing Act. The Federal Fair Housing Act, passed in 1968 and amended in 1988, prohibits the discrimination in housing on the basis of race, color, national origin, religion, gender, familial status and disability. The Fair Housing Act covers most types of housing including rental housing, home sales, mortgage and home improvement lending, land use and zoning. New Mexico Fair Housing Law. New Mexico passed the New Mexico Human rights Act in 1969 which prohibits discrimination in the rental, assignment, lease and sublease of housing. In addition, the NMHRA prohibits discrimination on the basis of race, religion, color, national origin, sex, physical and mental handicap, ancestry, sexual orientation, gender identity, and spousal affiliation.
