Police Identify Man Found Dead Near Rosario Cemetery

Mark Ginnel, 55, was found dead Tuesday, September 10, 2013. His body was discovered just before 10 a.m. after an employee noticed him lying near an arroyo just outside the grounds. He was dead when police arrived. Investigators determined he was badly beaten which lead to his death, but the scientific cause is still under investigation pending a final determination from the Office of the Medical Investigator.

Witnesses lead detectives to the suspected attacker Orlando Yazzie, also known as Red Eyes, 37, who admitted to police he was drinking in the arroyo (where the victim was found) Monday around 3 p.m. when he and Ginnel got into a fight. Yazzie said he punched Ginnel who ‘went to sleep’. Yazzie then explained he continued to drink near the scene of the fight, returned a few hours later and kicked Ginnel in the head repeatedly. Yazzie, a Native American, told police he was upset because the victim called him a ‘cheap Indian’.

Yazzie is being held at the Santa Fe County Detention Center on a $1Million cash only bond, charged with an open count of murder.

Both men are believed to be homeless. The victim’s next of kin has been notified. 

Beer cans, energy drink cans and hard liquor containers were found at the scene. Yazzie admitted to police he was drinking during the crime.

Yazzie has a lengthy criminal record with SFPD. He has been arrested 28 times since 2010 for multiple crimes including assault on a peace officer, assault, aggravated battery, drinking in public, disorderly conduct and shoplifting.
